The benefit of the authentic act for communities
In addition to the guarantees of notaries' impartiality, the advantage of the notarial deed consists in the very great technical and financial guarantee due to the contracting parties. The notarial act alone is in a position to guarantee and limit the responsibilities of mayors and presidents of communities, both civil and criminal.
Authorization to occupy the public domain
This authorization is always temporary, precarious and revocable. Local authorities can on their public domain:
- Conclude an "Administrative Emphyteutic Lease" or BEA
- Issue "Temporary Occupancy Permits" or AOT
Since the law Pinel (2014), a goodwill can be constituted on the public domain and can be compensated by the administration.
